The short version: you must be 21+. Bluntly Zen helps you discover cannabis-friendly places and information; we don't sell cannabis, and what you do with what you find is your responsibility under the law where you are. Bookings and purchases happen with the business, not with us.
1. Agreement
These Terms of Use ("Terms") are an agreement between you and Ventyour Inc., a Delaware corporation ("Ventyour," "we," "us" or "our"), which owns and operates Bluntly Zen at bluntlyzen.com and related services (the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
2. You must be 21 or older
The Service is only for adults 21 and older. By using it, you confirm that you are at least 21 and legally able to enter into these Terms. We may ask you to confirm your age and may close accounts that don't meet this requirement.
3. What Bluntly Zen is, and isn't
- Bluntly Zen is a discovery, information and hospitality platform. We list stays, lounges, experiences, events, dispensaries and other businesses, and publish guides and stories.
- We do not sell, supply, deliver or facilitate the sale of cannabis, hemp products or any controlled substance.
- Cannabis remains illegal under U.S. federal law except in limited circumstances, and state, local and international laws vary widely and change often. You are solely responsible for knowing and following the laws where you are, including laws on possession, consumption, driving and crossing state or national borders.
- Content on the Service, including our law guides, wellness guide, news and blog, is general information, not legal, medical or professional advice. Talk to a qualified professional about your situation. Don't drive or operate machinery while impaired.
4. Listings and third parties
Listings, events, creator profiles and dispensary data come from businesses, public records and other sources. We work to keep them accurate, but hours, prices, policies, licenses and availability change, and we don't guarantee that any listing is accurate, complete or current. Inclusion in Bluntly Zen is not an endorsement, and a listed business or creator is not necessarily affiliated with us.
When you book a stay, buy a ticket or a product, or use any other third-party service, you deal directly with that third party under its own terms. Ventyour is not a party to those transactions and is not responsible for third-party goods, services, websites or conduct. Some links are affiliate links, which means we may earn a commission at no extra cost to you.
5. Stays and accommodations
Stays shown on Bluntly Zen, including those labeled "cannabis-friendly," "420-friendly," "Cannabis Welcome," "Outdoor Consumption," "Vape Friendly" or similar, are provided for discovery only. Please read this section carefully before booking.
- We are not the host or booking agent. Ventyour does not own, operate, manage, inspect, license or control any property. Reservations, payments, cancellations and refunds are handled by the property or its booking provider under their own terms. Ventyour is not a party to your booking and is not your agent or the host's agent.
- Labels are based on information from hosts and public sources. Cannabis policies, amenities, photos and descriptions come from the property, its listings or other public sources and may be incomplete, out of date or changed without notice. Some stays may be shown as illustrative samples. A label is not a promise that consumption is allowed. Always confirm the property's current cannabis policy and house rules in writing directly with the host before you book and before you consume.
- The law and the house rules come first. A property's permission does not make cannabis use legal. You are responsible for complying with state and local law, building, HOA, lease and fire rules, and any smoke-free laws. Many hotels, rentals and multi-unit buildings prohibit smoking of any kind, and some jurisdictions prohibit consumption anywhere visible to the public.
- Fees and damages are your responsibility. Hosts may charge cleaning, smoke-remediation or damage fees, cancel a stay, or ask you to leave for breaking their rules. Ventyour is not responsible for any such fees, cancellations or disputes.
- Safety and conditions. We do not verify a property's safety, accessibility, licensing, insurance or condition. Use good judgment, don't drive impaired, keep cannabis away from children and pets, and never smoke in bed or near anything flammable.
- No liability for stays. To the fullest extent permitted by law, Ventyour is not liable for any loss, injury, illness, property damage, theft, legal penalty, citation, fine, eviction, cancellation, overbooking, refund dispute or other harm arising from any stay, property, host or booking provider, or from your possession or use of cannabis at a property. Any claim relating to a stay is solely between you and the host or booking provider.
6. Your account
Keep your login details secure and accurate. You're responsible for activity on your account. Tell us right away at hello@bluntlyzen.com if you think someone else has accessed it. You can close your account at any time.
7. Business accounts and submissions
If you list or submit information about a business, you confirm that you're authorized to do so, that the information is accurate, and that the business holds any licenses it needs. You give us a non-exclusive, worldwide, royalty-free license to host, display, adapt and promote that information on the Service and in our marketing. Paid placements or partnerships, if offered, will be governed by a separate written agreement.
8. Acceptable use
You agree not to:
- use the Service to buy, sell, arrange or advertise the illegal sale or transport of cannabis or any controlled substance;
- let anyone under 21 use your account or the Service;
- post or send content that is false, unlawful, harassing, hateful, infringing or that invades someone's privacy;
- scrape, copy or harvest data from the Service at scale, or use bots to access it, except as allowed by our robots.txt;
- interfere with the Service's security or operation, or try to access accounts or data that aren't yours;
- impersonate any person or business, or misrepresent an affiliation.
9. Our content and brand
The Service, including its design, text, graphics, logos and the Bluntly Zen name and lotus mark, is owned by Ventyour or its licensors and is protected by intellectual-property laws. You may view and share links to the Service for personal, non-commercial use. You may not copy, modify, distribute or create derivative works from it without our written permission. Some photos are used under Creative Commons or other licenses and remain the property of their owners, as credited.
If you believe content on the Service infringes your copyright, email hello@bluntlyzen.com with a description of the work, where it appears on our site, your contact information, and a statement that you have a good-faith belief the use isn't authorized. We will review and respond, and may remove content.
10. Feedback
If you send us ideas or suggestions, we may use them without any obligation to you.
11. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, Ventyour disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We do not warrant that the Service will be uninterrupted, error-free or secure, or that any information on it is accurate, complete or current.
12. Limitation of liability
To the fullest extent permitted by law, Ventyour and its officers, directors, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, or for any legal consequences of your possession, use or transport of cannabis or hemp products, arising out of or related to the Service or any third-party business, product, event or website. Our total liability for any claim related to the Service will not exceed the greater of one hundred U.S. dollars (US$100) or the amount you paid us in the twelve months before the claim.
Some jurisdictions don't allow certain disclaimers or limits, so some of the above may not apply to you.
13. Indemnity
You agree to defend, indemnify and hold harmless Ventyour and its officers, directors, employees and agents from any claims, losses and expenses (including reasonable attorneys' fees) arising from your use of the Service, any stay, experience or purchase you arrange through a link on the Service, your conduct at any property or venue, your content or submissions, your violation of these Terms, or your violation of any law or the rights of others.
14. Suspension and termination
We may suspend or end your access to the Service at any time if we believe you've violated these Terms or the law, or to protect the Service or other users. Sections that by their nature should survive termination will survive, including Sections 3, 4, 5, 9 and 11 through 17.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You and Ventyour agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and both consent to personal jurisdiction there. Before filing a claim, you agree to contact us at hello@bluntlyzen.com and try to resolve it informally for at least 30 days.
16. Changes
We may update these Terms. If we make material changes, we will post the new Terms here with a new effective date and, where appropriate, notify account holders. Continuing to use the Service after changes take effect means you accept them.
17. General
These Terms and our Privacy Policy are the entire agreement between you and Ventyour about the Service. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
